Web Site Hosting Service Agreement

TERMS AND CONDITIONS

DEFINITIONS

  • Agreement means the inter.net.works's Web Site Hosting Services Agreement, these Terms and Conditions, and the Service Order attached hereto, collectively.

  • Customer means the entity identified on the contract of the inter.net.works Hosting Services Agreement, including but not limited to any permitted successor or assignee of Customer.

  • Web Site means any collection, delivered by Customer to inter.net.works, of multimedia, interactive computer programs and data files that are designed to inter operate with each other on the World Wide Web portion of the Internet. "Web Site" shall include but not limited to any intellectual property and Customer Materials that may be contained in such programs and data files.

  • Web Site Content means the materials, information and services contained, displayed, linked, framed by, downloaded or accessed by or through a Web Site and links contained within such Web Site, including but not limited to (a) text, graphics, art, photographs, advertisements, other audio or visual assets, and links to or frames of other web sites (b) the contents of any bulletin boards, chat forums or other communications services (c) any service provided by or through the Web Site (d) any materials and information, including but not limited to as described in Subsections (a) through (c) of this Section, that are made available or displayed on or through the Web Site by means of links to or framing of other web sites, and (e) all updates, upgrades, modifications, and other versions of any of the foregoing, including but not limited to modifications made by users of the web site.

COVENANTS & RESPONSIBILITIES

  • This service is provided for both personal and business sites.

  • inter.net.works does not permit the Customer to use web space for providing material that is grossly offensive to the internet community including blatant expressions of bigotry, racism, hatred, or profanity, or for promoting or providing instructional information about illegal activities, or promoting physical harm or injury against any group or individual.

  • The Customer undertakes that he or she shall not use the service in any manner that contravenes with any license granted to GT&T or inter.net.works.

  • inter.net.works's hosting does not allow chat rooms of any kind.

  • inter.net.works is not responsible for web page content, and the opinions and views expressed in web pages do not necessarily reflect those of inter.net.works.

  • Pages cannot contain, of contain links to, any of the following: copyrighted material not belonging to the Customer, nudity, sex, pornography, foul language, hate propaganda, anything illegal, mail fraud, or insulting to another person (s) or company (s).

  • Hacking or unauthorized access to any system or database, sending bulk/spam email from inter.net.works server, or sending such email with the inter.net.works' web site listed as the contact address is grounds for immediate removal from the inter.net.works service. inter.net.works forbids mass/spam news posting and reserves the right to remove any accounts advertising or distributing software or services that may contribute to news or email spamming.

  • inter.net.works reserves the right to remove any web site or page it deems unacceptable for any reason without prior notice.

  • The Customer agrees to assume full responsibility for the web page or site and its contents. The Customer hereby states that the page or site contains nothing illegal, pornographic, degrading or abusive to another person, including pages that promote hate group propaganda. The Customer agrees that inter.net.works has the right to remove any page it determines, in its sole judgment, has violated these conditions. By submitting the Service Order, the Customer agrees to all the conditions of this Agreement.

  • inter.net.works reserves the right to modify this agreement at any time.

  • Any pages that do not comply with the above guidelines will be removed.

INDEMNIFICATION

Customer agrees to indemnify, defend  at its expense and hold harmless inter.net.works, its agents, its clients and employees, from any and all Losses and threatened Losses arising from, in connection with, or based on allegations of any Customer Materials, including but not to limited to Looses or threatened Losses arising from (a) the authorized or unauthorized use of such materials by users of the Web Site, (b) any violation of applicable laws arising from such material or from the authorized or unauthorized use of such material by users of the Web Site, (c) viruses or similar destructive code contained within such material or otherwise introduced into inter.net.works's system by such material, and (d) the infringement or alleged infringement of the proprietary rights of the third party by such material of inter.net.works's use of such material pursuant to this Agreement.

INTER.NET.WORKS SHALL HAVE NO LIABILITY FOR ANY DOMAIN NAME , OR FOR ANY BREACH OF SECURITY, THIRD PARTY LOSS, DAMAGE, FAILURE, LOSS OF DATA, OR DEGRADATION OF PERFORMANCE RELATED TO ANY CUSTOMER MATERIAL, ANY WEB SITE OR SERVICE.

TERM

The term of this Agreement (the "Term") shall begin on the Effective Date, as stated in the Service Order, and shall remain effective, unless terminated earlier in accordance with these Terms and Conditions. Thereafter, the Term shall be automatically renewed on a month-to month basis for one-month periods at then-current month-to-month charges until (a) thirty (30) calendar days after the Customer provides inter.net.works with a written notice of its intent not to renew this Agreement, or (b) any termination of this Agreement pursuant to these Terms and Conditions. Upon termination of this Agreement, Customer shall pay all amounts that are due and unpaid prior to to such termination.
